1. About these terms
These Terms & Conditions (“Terms”) apply to all orders placed with Harvey & Mueller ABN 00 000 000 000 (“we”, “us”) for custom-made engagement rings and related goods or services.
By approving a design quote, making a payment, or otherwise placing an order, you agree to these Terms. Nothing in these Terms limits rights you have under the Australian Consumer Law (“ACL”) in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
2. The design process
Our engagement begins when you submit a consultation request. We will respond within one business day with questions and, if the project is a good fit, arrange a design call.
Following the design call we produce pencil sketches for your approval — free of charge and without obligation. A binding order is only created when:
- You have approved a final quote in writing (email is sufficient); and
- We have received the deposit described in clause 4.
We reserve the right to decline any project at our discretion, including after a consultation call.
3. Custom-made goods
All rings made by Harvey & Mueller are custom-made to your specifications. Because each ring is made to order, your right to a change-of-mind return is limited (see clause 7). This does not affect any rights you have under the ACL where goods are faulty or not as described.
4. Pricing and payment
All prices are in Australian Dollars (AUD) and include GST unless stated otherwise. Quoted prices are valid for 30 days. After 30 days we may need to re-quote if stone or metal costs have changed.
A 50% deposit is required to commence production. The balance is due and payable prior to despatch. We will not ship a ring until payment is received in full.
We accept payment by bank transfer (EFT), credit card, and approved finance products (see our Finance options page). We do not accept cash or cheque.
5. Crafting timeframes
Standard production time is 4–8 weeks from deposit receipt, subject to stone availability. We will provide a specific estimated completion date when we acknowledge your order and will communicate any delays promptly.
Rush commissions (fewer than 4 weeks) may be available at an additional charge. Please advise us of your deadline before placing an order.
6. Shipping
We ship via Toll Priority Secure (domestic) or DHL Express (international), fully insured, signature required. Shipping is included in the quoted price.
Risk in the goods passes to you when you (or your authorised representative) sign for the parcel. Title passes upon receipt of full payment.
We are not responsible for delays caused by couriers, customs, or circumstances beyond our control. See our Shipping page for full details.
7. Returns, refunds, and cancellations
Because our rings are custom-made:
- Change of mind — we do not offer refunds or exchanges where you have changed your mind after production has commenced.
- Pre-production cancellation — if you cancel before stone sourcing or casting begins, we will refund your deposit less any reasonable costs incurred (typically design and consultation time).
- Faulty goods — if your ring has a manufacturing defect, we will repair or replace it at no charge. See our Warranty page for details.
Nothing in this clause limits your rights under the ACL. Our goods come with guarantees that cannot be excluded. For major failures you are entitled to a replacement or refund; for minor failures we are entitled to repair the goods.
8. Resizing and after-care
We offer one free resize within 12 months of delivery. Subsequent resizes are charged at our current labour rate. See our Resizing page for scope and limitations.
Complimentary polishing and rhodium re-plating (where applicable) are available at any time — just send the ring back to us at your cost and we will return it at ours.
9. Intellectual property
All sketches, design drawings, CAD files, photographs, and other creative materials produced by Harvey & Mueller remain our intellectual property. We grant you a personal, non-transferable licence to use them in connection with your ring. We may use images of your ring for portfolio and marketing purposes unless you ask us not to in writing before the order commences.
10. Limitation of liability
To the extent permitted by law, our liability to you for any loss or damage is limited to the amount paid by you for the relevant goods or services. We are not liable for indirect, consequential, or special losses arising from your order.
This limitation does not apply to liability that cannot be excluded under the ACL or any other applicable law.
11. Governing law
These Terms are governed by the law of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction to resolve any dispute arising under these Terms.
